These Terms of Service ("Terms") constitute a legally binding agreement between you and Think Big Technology LLC ("Think Big Technology," "we," "us," or "our") regarding your use of our IT support ticketing system and related services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

These Services are provided to businesses that have a valid IT support contract with Think Big Technology.
To use our Services, you must:
4.1 Account Creation: To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information.
4.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
4.3 Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.
By providing your phone number or email address, you expressly consent to receive communications from Think Big Technology regarding IT support services. This includes:
Email communications are sent for support ticket management. You may unsubscribe from non-essential emails by contacting us, but you will continue to receive service-critical notifications related to active support tickets.

You retain ownership of any content you submit through the Services (messages, attachments, etc.). By submitting content, you grant us a license to use, store, and display your content solely for the purpose of providing the Services.
The Services, including all software, designs, text, graphics, and other materials, are owned by Think Big Technology and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our written permission.
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
We comply with applicable data protection laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
9.1 Availability: We strive to maintain continuous service availability but do not guarantee uninterrupted access. The Services may be unavailable due to maintenance, updates, or circumstances beyond our control.
9.2 Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.
9.3 Updates: We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the modified Terms.
Our Services integrate with third-party providers including Twilio (SMS), SendGrid (email), Supabase (database), and Vercel (hosting). Your use of these services through our platform is subject to their respective terms and privacy policies.
We are not responsible for the practices or content of third-party services.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINK BIG TECHNOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SERVICES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Think Big Technology, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
Any legal action related to these Terms must be brought in the state or federal courts located in Essex County, New Jersey.
14.1 By You: You may stop using the Services at any time. To close your account, contact us at connect@thinkbigtechnology.com.
14.2 By Us: We may suspend or terminate your access to the Services immediately, without prior notice, if you violate these Terms or if your IT support contract is terminated.
14.3 Effect of Termination: Upon termination, your right to use the Services immediately ceases. Data retention is governed by our Privacy Policy.
15.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Think Big Technology.
15.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
15.3 Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.4 Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
